From what I believe, or at least think, didn't Carrey said that he'll retire from acting with the exception of Sonic movies? That Sega/Paramount will let him go when he asks to and won't recast Robotnik over it?

He's retired but not making exception for Sonic movies, he just said he might reconsider it. It could be interpreted he's just being nice in words while in the reality it's still a no.
And since so far no words of his willing to come back, the producer just went along with another villain instead of Robotnik since they don't want recast him.

That's fair. Though if Dr. Robotnik is official dead or not I'd rather some confirmation in Sonic 3. I mean, it's already established how determined Dr. Robotnik as a character is, I'd rather we see Agent Stone attend a funeral and vows to take up revenge or Jim Carrey willing to make Sonic 3 his swan song to his career.

I think I've read an interview where Jim Carey was asked about Sonic 3 and he answered that he might heavily consider to return if the team could make Robotnik different from Sonic 2.
Like making Robotnik fat (like how he looks in the game) or may be make Robotnik an AI where Stone serves the AI (this way Jim Carey could just lent his voice if he's too busy).
