Gonna need Yuji Naka's blessing to use NiGHTS.
Not because they have to since NiGHTS belong to SEGA, it's just an ethical thing to ask permission from the original creator.
Same with everytime they want to use Shenmue (Yu Suzuki), Toejam (Greg Johnson), orEcco (Ed Annunziata).

If Dremagen was never defeated at the game is no longer continued then that mean she is unopposed. She wins.

That's still just 'if". Who knows may be she had a change of heart like Shadow back then.

Gamefam: We're not doing Frozen Base anymore, we need a new map to promote Dream Team.
Map developer: B-but I just finished making this map!
Gamefam: Stop wasting time then and make this new map! C'mon! Hurry up!
Map developer: GOD DAMMIT!

I thought whoever is HARDlights representives for Sega could ask Sega for them.

May be but it's not on their priority list so if they had a chance to communicate with SEGA I'm assuming they're gonna focus more on Dream Team's gameplay.
All the cameos and cosmetics were usually discussed after all main things were set.
